Murder Stories engages with the current theoretical debate in death penalty research on the role of cultural commitments to ‘American’ ideologies in the retention of capital punishment. The central aim of the study is to illuminate the elusive yet powerful role of ideology in legal discourses. Through analyzing the content and processes of death penalty narratives, this research illuminates the covert life of ‘the American Creed,’ (a nexus of ideologies—liberty, egalitarianism, individualism, populism, and laissez faire—said to be unique to the United States) in the law.
Murder Stories draws on the entire record of California death sentence resulting trials from three large and diverse California counties for the years 1996 – 2004, as well as interviews with 26 capital caseworkers (attorneys, judges, and investigators) from the same counties. Employing the theoretical framework proposed by Ewick and Silbey (1995) to study hegemonic and subversive narratives, and also the ethnographic approach advocated by Amsterdam and Hertz (1992) to study the producers and processes of constructing legal narratives, this book traces the ideological content carried within the stories told by everyday practitioners of capital punishment by investigating the content, process, and ideological implications of these narratives.
The central theoretical finding is that the narratives constructed by both prosecutors and defenders tend to instantiate rather than subvert the ideological tenets of the American Creed.

Paul Kaplan is associate professor in the Program in Criminal Justice in the School of Public Affairs at San Diego State University. He received his Ph.D. in Criminology, Law and Society from the University of California, Irvine in 2007. Prior to entering academics, Dr. Kaplan worked as a mitigation investigator on capital cases in California. His primary research area is capital punishment, but he also works on projects involving socio-legal theory, cultural criminology, and comparative law. His work has appeared in journals such as the Law & Society Review, Theoretical Criminology, and Law & Social Inquirí

Abstract
Taking as a subject the comic opera for puppets written by António José da Silva in 1733, the essay analyses the scene IV of Part Two at three levels. At the first level it explores the interpretation of the Justice and functions of its iconography, where da Silva/Sancho Pança are fierce iconoclasts. At the second level the paper aims to verify the hypothesis of "absence of original" that connects the scene IV with The Fall (1956) by Albert Camus and the concept of "non-place" by Michel Foucault. Finally, at the third level, the essay analyses Justice's seriousness in the world of carnival through some ideas by Mikhail Bakhtin

What is the role of literature in the formation of the state? Anthony J. Cascardi takes up this fundamental question in Cervantes, Literature, and the Discourse of Politics, a comprehensive analysis of the presence of politics in Don Quixote. Cascardi argues that when public speech is constrained, as it was in seventeenth-century Spain, politics must be addressed through indirect forms including comedy, myth, and travellers' tales.
Cervantes, Literature, and the Discourse of Politics convincingly re-engages the ancient roots of political theory in modern literature by situating Cervantes within a long line of political thinkers. Cascardi notably connects Cervantes's political theory to Plato's, much as the writer's literary criticism has been firmly linked to Aristotle's. He also shows how Cervantes's view of literature provided a compelling alternative to the modern, scientific politics of Machiavelli and Hobbes, highlighting the potential interplay of literature and politics in an ideal state.

Samba no pé & Direito na cabeça propõe uma reflexão sobre o Direito nos tempos atuais, levando em consideração a recorrente judicialização de conflitos e a necessidade de o Direito se fazer presente no lugar comum.
Esta obra reúne artigos jurídicos inspirados em samba, e por meio da interpretação das canções são analisados temas como ensino jurídico, o direito ao meio ambiente, os direitos indígenas, o direito das famílias, o combate à corrupção, a criminalidade, a homoafetividade, o direito à cidade, o direito do trabalho, a formação dos juízes, a cidadania, a afrodescendência e a globalização.

Me ha llegado el envío de último número publicado de la revista Elementos de Juicio. Temas constitucionales (Bogotá D. C.. Colombia), ISBN: 978-958-98201-5-5, cuyo Consejo Editorial preside D. José Gregorio Hernández Galindo, ocupado asimismo de la Dirección, estando encomedada la subdirección a Dª. Laura Ospina Mejía.

J. Romero, publicado entre abril y mayo de 1992 en el diario bogotano La Prensa. Del relato de Romero existen ediciones más recientes por, entre otras, Ediciones Libertaria, Bogotá, 2003. En el comentario de Bastidas Bácenas se destacan temas relacionados con el derecho a la intimidad o el habeas corpus, y fue leído en su día con ocasión de la ceremonia en que Romero recibió la maestría de Literatura por la Universidad Javeriana.


Poeta en la cárcel es un relato de tintes kafkianos acerca de las pecualiares circunstancias que conducen a permanecer en prisión por varios días a un poeta imputado en un delito de estafa que en realidad había sido cometido por otro individuo mediante suplantación de identidad.

In Contempt: Nineteenth-Century Women, Law, and Literature, by Kristin Kalsem, explores the legal advocacy performed by nineteenth-century women writers in publications of nonfiction and fiction, as well as in real-life courtrooms and in the legal forum provided by the novel form.

The nineteenth century was a period of unprecedented reform in laws affecting married women’s property, child support and custody, lunacy, divorce, birth control, domestic violence, and women in the legal profession. Women’s contributions to these changes in the law, however, have been largely ignored because their work, stories, and perspectives are not recorded in authoritative legal texts; rather, evidence of their arguments and views are recorded in writings of a different kind. This book examines lesser-known works of nonfiction and fiction by legal reformers such as Annie Besant and Georgina Weldon and novelists such as Frances Trollope, Jane Hume Clapperton, George Paston, and Florence Dixie.

In Contempt brings to light new connections between Victorian law and literature, not only with its analysis of many “lost” novels but also with its new legal readings of old ones such as Emily Brontë’s Wuthering Heights (1847), George Eliot’s Adam Bede (1859), Lewis Carroll’s Alice’s Adventures in Wonderland (1865), Rider Haggard’s She (1887), and Thomas Hardy’s Jude the Obscure (1895). This study reexamines the cultural and political roles of the novel in light of “new evidence” that many nineteenth-century novels were “lawless”—showing contempt for, rather than policing, the law.

David E. Toohey’s Borderlands Media: Cinema and Literature as Opposition to the Oppression of Immigrants is an in-depth analysis which explores the immigrant experience using a mixture of cinema, literary, and other artistic media spanning from 1958 onward.
Toohey begins with Orson Welles’s 1958 Touch of Evil, which triggered a wave of protest resulting in Chicana/o filmmakers acting out against the racism against immigrant and diaspora communities. The study then adds policy documents and social science scholarship to the mix, both to clarify and oppose undesirable elements in these forms of thought. ¿Estamos quizá ante la recuperación de un género que en Francia inauguró, allá por 1925, Code Pénal, Commentaires imagés de Joseph Hémard (Éditions Littéraires de France, Paris, 167 pp.)?



Lo cierto es que Denise Cardia Saraiva, abogada, periodista e ilustradora, también ha lanzado en Brasil (Juruá Editora) a lo largo de los últimos años, y en varias ediciones sucesivas que prueban su buena acogida, tres volumenes de Direito Civil ilustrado (Parte Geral. Das Pessoas, ISBN: 85-87274-05-8; Dos Bens, ISBN: 85-87274-08-2; Dos Fatos Jurídicos, ISBN: 85-87274-09-0) y uno más de Parte Especial (Do Direito das Obragações, ISBN: 85-87274-12-0), así como otros tres de Direito Penal ilustrado (Parte Geral I, ISBN: 85-87274-01-5, Parte Geral. Dos Bens, ISBN: 85-87274-04-x, y Espacial, ISBN: 85-87274-11-2) [2ª ed. de este último, 2010, 332 pp. ISBN: 978853623052-8), obras todas ellas que protagonizan dos personajes memorables Marquinho y Caio.
Tal vez sea ésta una nueva ilustración jurídica. No es vana la afirmación.
